GENERAL TERMS AND CONDITIONS OF CONTRACT (DIRECT BOOKINGS)

1. Introduction
The present General Terms and Conditions of Contract apply to the contractual relationship between CAROWA TENERIFE, S.A. and the CUSTOMER.

CAROWA TENERIFE, S.A.U (henceforth CAROWA) is a Spanish company with its registered office at Calle Océano Pacífico 1, 38240 Punta del Hidalgo, Tenerife (Spain), registered in the Commercial Register of Santa Cruz de Tenerife, Tomo 641, Folio 1, Hoja TF-176.

The making of a reservation in the facilities managed by CAROWA implies the express and unconditional acceptance of all the terms and conditions of contract, which have the same validity and efficacy as any contract concluded and signed in writing. Compliance with and observance of these conditions applies to every person making a reservation and to all accompanying persons.

2. Limitation of liability
The possibility of concluding a contract with CAROWA exists for end customers of full age and for the customer's own consumption or for persons in whose name the CUSTOMER is legally authorised to act. Wholesale companies or agencies, distributors and other professional intermediaries are excluded. It is also completely forbidden to resell the products purchased through this website to third parties.

3. Use of the reservation service
The purpose of a reservation is the rental of hotel rooms as well as reserving other products and services offered by the hotel in this context.

The use of the reservation service implies full and unconditional acceptance and validity of each and every one of the general terms and conditions. These are considered to be automatically included in the contract with CAROWA, without the need for a written transcription of the same.

The making of a reservation implies the payment of 40 % of the accommodation price (including meals). The customer will receive an e-mail confirming the reservation subject to the correct receipt of payment to CAROWA. Once the payment of the reservation has been received, the CUSTOMER will receive another e-mail confirming this payment. This e-mail serves as proof of the reservation.

4. Prices and offers
For each service and product, the prices indicated on the website www.oceano.de on the day of the reservation, including the I.G.I.C. (Canary Islands VAT) according to the rate in force at that time, will be applied. If the tax rate changes between the date of the reservation and the date of use, resulting in an inequality, the tax rate applicable to the final price will be the one in force at the time of use of the services, even in cases where this results in an increase in the final price indicated to the CUSTOMER at the time of reservation.

If, on the other hand, additional taxes or charges are incurred in accordance with the applicable local and/or regional regulations, these taxes must be paid directly to the hotel.

Offers are duly identified and marked as such, with the previous price and the price of the offer being indicated. CAROWA reserves the right to make any changes it deems appropriate on the Website at any time and without prior notice and may update products and services accordingly on a daily basis.

5. Means of payment
CAROWA guarantees the CUSTOMER the security of its transactions in accordance with the current technical standards and security services customary in the industry.

A deposit of 40 % of the accommodation price (including meals) must be paid. This deposit is due at the moment of reservation. The deposit of the reservation is always paid by credit card.

In the case of payment by credit card, where the cardholder is not the one making the reservation, the cardholder must provide additional information to that required at the time of purchase. If this information is not provided correctly, neither the payment nor the reservation will be considered valid.

The CUSTOMER, who makes the reservation in person at the establishment, by e-mail or by telephone, may also make the payment by bank transfer to the account indicated by CAROWA, all expenses and costs being borne by the CUSTOMER.

The balance of the accommodation price and other contractually agreed services will be paid on site. Payment on site can be made by credit or debit card or cash.

6. Modification and cancellation of reservations

The CUSTOMER can change the reservation by contacting the CAROWA Reservations Department on +34 922 156 000 or e-mail to reservation@oceano-tenerife.com.

The rebooking fee is 50,00 € and, in addition to any other possible costs resulting from the requested change (extension of the length of stay, change of data with a different tariff, other services, etc.), will be charged to the credit card used at the time of booking or paid by bank transfer.

The CUSTOMER may cancel or recall his reservation at any time by contacting the CAROWA Reservation Department by telephone on +34 922 156 000 or by e-mail at reservation@oceano-tenerife.com.

The following conditions apply if this is not explicitly stated otherwise in the respective booking confirmation:

In case of cancellation up to 30 days prior to the date of arrival, 20% of the total amount of the contractually agreed stay (accommodation and breakfast) will be charged. CAROWA will only refund the CUSTOMER the amount paid in excess of this 20%.
In case of cancellation between 29 and 22 days prior to the date of arrival, 40% of the total amount of the contracted stay (accommodation and breakfast) will be charged, and CAROWA will refund to the CUSTOMER only the amount paid in excess of this 40% or charge the difference between the cancellation costs and the amount paid at the time of reservation to the CUSTOMER's credit card or request payment by bank transfer.
In case of cancellation between 21 and 8 days prior to the arrival date, the cancellation fee shall be 60% of the total amount of the contracted stay (accommodation and breakfast) and CAROWA shall refund to the CUSTOMER only the amount paid in excess of this 60% or charge the corresponding difference between the cancellation fee and the amount paid at the time of reservation to the CUSTOMERS's credit card or request payment by bank transfer.
In the event of cancellation between 7 and 1 day before the arrival date, the cancellation fee shall be 80% of the total amount of the contracted stay (accommodation and breakfast) and CAROWA shall refund to the CUSTOMER only the amount paid in excess of this 60% or charge the corresponding difference between the cancellation fee and the amount paid at the time of reservation to the CUSTOMER's credit card or request payment by bank transfer.

In case of cancellation on the same day of arrival or in case of "no show", no refund will be made to the CUSTOMER, who will have to pay for the entire stay (accommodation and breakfast), as well as any additional services (transfer or similar) that cannot be cancelled. Therefore, the credit card used to pay the deposit will be debited with the balance of the total amount of the stay contracted, which was not paid at the time of reservation. Alternatively, payment can be requested by bank transfer.

7. Arrival and departure
Check-in at the hotel is possible from 2 pm.
The latest checkout is at 11 am. In case the CUSTOMER does not respect the departure time, he/she may be asked to pay the cost of an extra day of accommodation.

8. Processing of personal data
The Personal Data that you provide to CAROWA will be kept in files owned by CAROWA TENERIFE, S.A. for the following purposes

the execution and management of the reservations requested by the CUSTOMER, as well as the provision of the contracted services and their invoicing and accounting.
Sending the confirmation or other documents of the reservation made.
if authorised by the CUSTOMER by ticking the appropriate box on the reservation form, the sending of personalised commercial communications concerning products and services of CAROWA and of Océano Reisen GmbH & Co.KG and other companies cooperating with CAROWA.

The CUSTOMER may exercise his/her rights of access, rectification, cancellation, and opposition by sending notification to CAROWA to the e-mail address administracion@oceano-tenerife.com or by post to CAROWA TENERIFE.

9. Intellectual and industrial property
The intellectual and industrial property rights to the creations, brands, logos, images, and all other content contained on this website are the exclusive property of CAROWA and/or Oceano Reisen GmbH & Co KG. The unauthorised reproduction, distribution, commercialisation or transformation of such creations, brands, logos, photographs, etc. constitutes an infringement of copyright and may lead to the exercise of judicial or extrajudicial measures that may be taken by the aforementioned companies to defend their rights. Similarly, the information to which the CUSTOMER has access via the Site may be protected by intellectual and industrial property rights. CAROWA and/or Oceano Reisen GmbH & Co KG shall in no case and under no circumstances be responsible for any infringement of these rights by the CUSTOMER.

10. Jurisdiction and applicable law
In the event of any conflict or discrepancy in the interpretation or application of these contractual terms and conditions, Spanish law will apply and the courts and tribunals that may be competent to deal with the matter will be the courts of San Cristobal de La Laguna (Tenerife).
